SASKARA COUNSELLORS (“SASKARA”) FREE CONSULTATION TERMS AND CONDITIONS :

The Free Consultation (“FC”) is provided by Saskara to any legal entity upon full acceptance of the Saskara’s FC terms and conditions as given below:

1. The following terminology of this FC Terms and Conditions shall have corresponding meaning as given below:
1.1 Affiliates shall refer to spouse, heirs, director, commissioner, shareholders, subsidiary, parent company, group company, officer, employee, customer, vendors, suppliers, client, lawyer, accountant, tax consultant, or any of the Recipient’s authorized representative appointed prior or after the FC provided by Saskara.
1.2 Applicants shall means any party inquiring FC by submitting FC From and accepting Saskara’s FC terms and conditions.
1.3 FC shall refer to interaction between Saskara and any entity whether by face to face meeting, telephone by landline, mobiles or free online calls, text messaging or email communication, intended to provide basic review on the matter discussed whether or not followed by an engagement between the Recipient and Saskara, or not.
1.4 Information(s) shall refer to any details shared by Applicant and/or Recipient by submission of FC Form including but not limited to the identity of the Applicant and/or Recipient, identities of other party involved, and summary of the issues for consultation.
1.5 FC Form shall refer to form in the FC page in Saskara’s website.
1.6 FC Requirements shall refer to Recipient submission of FC Form and Recipient acceptance of this FC Terms and Conditions.
1.7 Recipient shall refer to any Applicant receiving FC upon selection by Saskara after completing the Saskara’s FC Requirements.
2 Saskara shall have the full discretionary right to select the entity to which it agrees to provide FC, upon Saskara’s own terms and conditions. Submission of FC Form and acceptance of FC Terms and Conditions does not oblige Saskara in any way to provide FC to the Applicant.
3 Applicant and Recipient should identify the other party involved in the matter that is to be discussed for the purpose of Saskara’s conflict of interest internal checking.
4 FC is only provided upon fulfilment of FC Requirements. FC Form and Recipient acceptance of this FC Terms and Conditions is an integrated and inseparable part. Saskara only accepts appointment-based consultation and shall have the full right to refuse a walk in client. FC is only provided for 1 (one) time for each Recipient for maximum 1 (one) email reply or maximum 30 minutes direct communication by telephone by landline, mobiles or free online calls, text messaging or email communication, except the Recipient and Saskara enter into a Pro Bono service engagement.
5 FC does not covers :
a. Acting as witness or acknowledging party to a signature for any purpose whatsoever;
b. Provision of legal assessment of any kind;
c. Reviewing Recipient’s self-drafted documentation;
d. Reviewing any contracts or other materials to an extent that the Recipient can make decision and/or act based on the advice provided;
e. Provision of legal advice.
6 By submitting the FC Form and clicking the “I hereby accept FC’s Terms and Condition” box at the bottom of the FC Terms and Conditions page, Applicant and Recipient hereby warrant to Saskara that (i) the information provided are accurate and correct, (ii) Applicant and Recipient are the owner of the Informations that Applicant and Recipient share with Saskara, (iii) that Applicant and Recipient have the legal rights or authority or have obtained the required permission to share any Information shared with Saskara for the purpose of the FC, and (iv) the share of such information to Saskara shall not violate any agreement with any party or the prevailing law. (v) As an Applicant and Recipient you hereby expressly assume all responsibilities and consequences arising due to the sharing of such Information to Saskara for the purpose of the FC, and thereby full indemnify and hold Saskara harmless from any law suit, demand, claim or objection submitted by any third party without exception.
7 Applicant and Recipient hereby acknowledge that Applicant and Recipient have properly perform conflict of interest checking before submitting the form and clicking the “I hereby accept FC’s Terms and Condition” box at the bottom of the FC Terms and Conditions page.
8 The provision of FC by Saskara does not constitute any engagement whatsoever between Saskara and the Recipient, nor impose the obligation on Saskara to conclude a Service Engagement with Recipient. Recipient is prohibited from introducing Saskara as lawyer or any title which substantially gives an impression to any party that Saskara is Recipient’s authorized representative.
9 Should after FC being provided the Recipient does not engage Saskara’s service by signing and meeting the Saskara’s service engagement terms and conditions, consequently Saskara is free to represent any party in relation to the matter to which the Recipient and/or FC relates, and the Recipient therefore expressly agrees to refrain from filing objection, demand, claim or law suit whatsoever to Saskara on basis of conflict of interest.
10 Recipient hereby expressly declared that Recipient fully understand that Saskara’s FC is given based on limited disclosure of Information, and allows limited knowledge and/or understanding for analysis by Saskara therefore should not be deemed as Saskara’s legal or business advise. Recipient are prohibited from the use of FC to be presented for legal or business decision, or evidence for submission of police report or submission as evidence before the court of law or arbitration bodies or any other alternative dispute settlement. Furthermore, Recipient hereby indemnify and hold Saskara completely harmless from any damage, loss of profit, or consequences of any kind due to the use of Saskara’s FC as basis for legal or business decision, or evidence for submission of police report or submission as evidence before the court of law or arbitration bodies or any other alternative dispute settlement.
11 FC is given exclusively for the Recipient and shall not include its Affiliates, and therefore should not be disseminated, distributed, copied, disclose, to any party other than the Recipient itself by any means.
12 Saskara shall treat the Information provided to it by Applicant and Recipient as confidential and privileged Information, and therefore shall not use it for its client advantage or transfer or disclose it to any other party. No notes of the FC will kept by Saskara. Notes, if any, will be electronic and will not be made available to the Recipient. No copies of documents will be made or retained.
